5th Grade Reading Test Required

Is it alarming that 4 out of the 9 supreme court justice can’t read English.

The U.S. Supreme Court ruled Thursday that Washington D.C.’s sweeping ban on handguns is unconstitutional.

The justices voted 5-4 against the ban with Justice Antonin Scalia writing the opinion for the majority.

You would think for such an important position in our government that there would be a minimum requirement for being able to read. Congress should pass a law requiring nominated justices to pass a 5th grade reading test before becoming a supreme court justice. That way we can be sure that the justices have read the constitution when they rule on the constitution.

I thought the 4 of them in the minority were just trying to be humorous.

Let’s all remember that a literal interpretation of the Constitution would still give black people 3/5th of a vote. One of the standards by which the Supreme Court judges the validity of particular parts of the Constitution is whether the article is arcane, ie, an artifact of a different time with no bearing on the current situation in America. Since no one is training for well-regulated militias, it can be pretty easily argued that the Secong Amendment is arcane. Obviously the majority didn’t come to that conclusion this time, which is fine with me, but let’s not pretend that it’s such a black and white issue.

If it’s arcane then it’s time to amend the constitution (good luck with that). Otherwise, it is the supreme law of the land. I do not feel comfortable with a supreme court justice saying, “Oh, this ‘constitution’ is arcane so I’m going to ignore it.”

And it IS black and white sir. Just because there is not much of a militia presence does not mean we have given up the right to form one. However, if we allow the government to outlaw firearms, then we have for all intents and purposes given up the ability, the right, to form a “well regulated militia.”

Hence the second half of the contentious amendment:

“the right of the People to keep and bear arms shall not be infringed.”

    wrong

I don’t understand because Joey is in grad school and yet he can’t read basic English sentences.

The 3/5ths of a vote thing was never ammended either, does that mean you support it? It’s nice that you think things should work that way, but they simply don’t, and I’m confident that the Supreme Court Justices know more about Constitutional law than either of us.
